Factory built housing (FBH) is an automated construction version of a site built residential structure. Other than using automated construction, there is little or no difference between factory built housing and site built residential structures. It is not uncommon for FBH to be called “modular”or “Prefab” housing as the home needs to be transported great distances which creates a size restriction as to width than can be transported from state to state. Consequently the factory will build the house so that it can be efficiently transported to the site. Thus the home’s unique design is made up of modules which are “stitched” together upon arrival. Some ignorance of facts regarding this building process has prompted some Realtors to wonder if disclosure of how the home was built is necessary. For this reason many involved in this field sought the advice and counsel of the California Association of Realtors regarding this matter. Many of the following facts support that disclosure is not a required nor necessary. The construction of residential structures subject to FBH laws and regulations requires the application of the California Code of Regulations, Title 24, California Building Standards Code and FBH laws and regulations.
FBH is always installed on a foundation designed to CCR Title 24 Requirements and is under the jurisdiction of the local building department for permits and inspection. FBH is not subject to HCD registration or titling; or to any form of dealer, salesperson, or manufacturer occupational licensing by HCD.
Local requirements imposed on factory built housing may not differ substantially from those imposed on other residential building of the same size.
All product design and construction is subject to the most current edition of the California Building Standards Code (CBSC), or International Building Code (IBC), the same as all site-built residential occupancies in California. Any person licensed as a Real Estate Agent by the California Department of Real Estate may sell FBH units using the same rules and requirements for the sale of site-constructed dwellings. Note: (once assembled on site, FBH units are thereafter treated the same as site built structures for the life of the structure.

The in-depth materials make it clear that in their eyes, the FBH is every bit as good if not better than on site construction and is merely a way to produce a product at somewhat less cost and in less time.
From California Association of Realtors legal advisors; “The general feeling is that if our lawyers were in the field as Realtors, they would not disclose. Disclosures are normally the result of a “material” fact, one that could also negatively affect the value of the property. We do not disclose ”positive” facts and if we do, it is not because they were required but used as a sales point.” Nothing in the materials made available by the State of California, or any other known source, point up any negative facts connected with FBH. Therefore there are no material facts to disclose.
This is a point Timberstone Construction feels important to address as whenever disclosure is an issue, as said above, it brings about a negative connotation and could be a sales deterrent
